 1. Cyclopark
The centre is managed by trustees. The premises shall be located at The Tollgate, Watling Street, Gravesend, Kent, DA11 7NP and is contactable on 01474 831400.
2. Data Protection
I agree that all data relating to my use of Cyclopark will be used solely by Cyclopark, partners and their trustees to improve services and products.
3. Acceptance
a) Upon acceptance of this application, the member shall be issued with a Cyclopark membership card (which will remain the property of Cyclopark) and shall be entitled to all the rights and privileges exercisable by the category of membership for which his/her application for membership has been accepted
b) Membership of Cyclopark shall constitute a binding and contractual agreement between Cyclopark and the applicant upon these terms and conditions of membership and rules and regulations of Cyclopark are from time to time in force.
c) Cards are issued to all members and must be shown at reception to gain entry every time a visit is made. Cards are not transferable and any use other than entry by the member may result in cancellation of that membership with no refund available.
d) Having purchased a membership package and you do not attend, you will not be entitled to a refund of your fee(s)
e) Membership is at absolute discretion of Cyclopark. Cyclopark reserves the right to request proof of all the information given to obtain membership.
h) A photo record is required at the time of joining and is retained on our computerised membership system as a means of identification.
4. Limitation of liability
a) In consideration for Cyclopark accepting his/her application for membership of Cyclopark and for he/she becoming and remaining a member of Cyclopark, the member agrees that;
b) Neither Cyclopark, nor its employees or agents shall be liable for any loss, damage or theft of any property belonging to, or brought on to the premises by the member or any guest of the member, occurring upon the premises.
c) Neither Cyclopark nor any employees or agent of Cyclopark shall be responsible for any death, persona injury or illness occurring upon the premises or as a result of the use of the facilities and/or equipment provided by the Cyclopark, except that such death, personal injury or illness arises from any negligent act or omission of Cyclopark or its employee or agent
d) Cyclopark cannot be held responsible for any service or facility being unavailable for reasons outside of our control.
e) Cyclopark liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount, having regard to such factors as whether the loss or damage was due to negligence by us.
f) Relevant United Kingdom law shall apply to this contract and the relevant courts of the United Kingdom shall have exclusive jurisdiction to deal with any disputes arising in relation to it.
5. Physical Condition of Member
a) The member warrants and represents that he/she is in good physical condition and that he/she knows of no medical or other reason why he/she is not capable of engaging in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort or physical condition (excludes Health Matters that have been bought to the attention of Cyclopark and cleared to exercise).
b) The member shall not use any facilities whilst suffering from any infections or contagious illness, disease or other ailment or whilst suffering from any physical ailment such as open cuts, abrasions, open sores or minor infections where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of the other members.
c) Before participating at Cyclopark, the member must first complete a Health Commitment Statement (HCS)..
d) Any member who is aware of any reason why they should not begin exercising or feels that exercise may exacerbate an existing health condition should seek advice from their Doctor prior to exercising at Cyclopark.
Cyclopark respects the decision of individuals to take part in regular exercise but expects that all users take the necessary steps to to take responsibility for their own health & wellbeing.
e) Members and their guests are required to comply with all reasonable requests and instructions in relation to the health and safety of themselves, other customers and staff.
6. Membership
Specific membership categories, the benefits and prices are available at each centre and form part of ‘Cyclopark Guidelines’. All membership shall be subject to these terms and conditions and the rules and regulations of Cyclopark as are from time to time in force. The membership shall be on such terms as the company may specify from time to time.
Cyclopark reserves the right to verify, or require proof of all information given in order to obtain such membership could result in the cancellation of all membership rights and/or reimbursement of all monies due to the company.
Membership is non-transferable.
7. Monthly Membership Charge
Monthly membership fees and any pro-rata payments must be paid in accordance with the conditions set out irrespective of actual usage of the facilities. All monthly payments will be paid via direct debit.
If you default on a direct debit payment for any reason, the membership will be suspended until the payment for the missed amount is made.
You are liable to pay all membership fees irrespective of your use of Cyclopark.
Cyclopark may increase monthly membership fees. Cyclopark shall give the member not less than 14 working days’ notice of any such increase.
8. Freezing Membership
You may be able to freeze your membership free of charge for medical reasons (as long as you provide acceptable medical evidence), for between one and 3 calendar months, as long as you have completed one calendar month of membership. ‘Freezes’ begin on the 1st of each month and you need to request the freeze at least seven working days before this time. Please note you will not be able to use the facilities while your membership is frozen. Please sign below to indicate your awareness of and agreement to these terms:
9. Expulsion of Members
Cyclopark may terminate the membership of any member: Without notice and with immediate effect if the member’s conduct, whether or not such conduct is the subject of complaint by another member or members, is such that in the reasonable opinion of Cyclopark, it may be injurious to the character or interests of Cyclopark, or is such that it renders the member unfit to associate with other members of the Cyclopark.
Without notice and with immediate effect if the member shall have committed any breach of these terms and conditions or of the rules and regulations of Cyclopark as are from time to time in force.
By notice in writing if any part of the initial subscription fee or the monthly membership charge which is due and payable remains unpaid 30 days after the due date for payment.
All decisions of Cyclopark under this clause are final and binding
A member whose membership is terminated shall forfeit all the privileges of membership with immediate effect without claim for any refund of his/her initial subscription fee or monthly membership charges and shall remain liable for any part of the initial subscription fee which remains due and owing to Cyclopark at the date of termination of membership. On termination of his/her membership, the member shall return forthwith his/her membership card and any other evidence of membership provided to that member by Cyclopark.
 10. Cancellation of Membership
1. Cancellation of any Cyclopark Membership, paid via DIRECT DEBIT requires 2 full calendar month’s written notice. All notice periods must be aligned with the ongoing monthly Cyclopark membership payment schedule.
b) All memberships can be cancelled within a 14 day ‘cooling off period’ providing the facilities have not been used within that time.
c) Cancellation of membership can only be accepted by email or in writing. If posting the form, please ensure the letter is dated and will arrive within the 1 week period. It is advised that the letter is sent via recorded delivery to ensure that it has been received. Alternatively, a letter can be handed to a member of staff on the reception team.
d) It is the responsibility of the member to cancel their direct debit with their bank. Cyclopark cannot be held responsible for any subsequent payments that are processed due to the failure of the member to do so.
e) In the event of the death of a member during the term of his/her membership of Cyclopark, the obligation to monthly Direct Debit charges or any remaining annual fee shall cease with effect from the date of death and due monies will be returned.
2. Cancellation of any Cyclopark Membership, with one ANNUAL PAYMENT is not permitted and the cancellation policy does not apply, except for the following:

Some areas of Cyclopark may be closed due to events or bad weather conditions. It is advisable to check the opening schedule of Cyclopark prior to arriving to avoid disappointment. Should an area of the park be closed of which your membership has been bought, we do not offer refunds or compensation. Our opening schedule can be found on our website at www.cyclopark.com and by visiting our ‘what’s on’ page or by contacting the centre on 01474 831400 or at reception@cyclopark.com. This statement is applicable to all memberships who have paid via direct debit or by a one off annual payment.
11. Facilities
Certain categories of membership do not include all services and facilities; services and facilities not so included may be provided at an additional charge at Cyclopark discretion.
Reasonable alterations to the types of facilities/special events provided without notice at its absolute discretion and Cyclopark shall not be liable for any loss occasioned by such alterations.
12. Hours of Opening
a) Cyclopark normal hours of operation and the hours in which any facilities are available to members are obtainable from Cyclopark upon request. Such hours may be lengthened or shortened at the absolute discretion of Cyclopark with or without any prior notice to members being given. Cyclopark shall endeavour to give reasonable notice of any lengthening or shortening of such hours.
On occasions when necessary maintenance is required; Cyclopark may be closed. Cyclopark shall endeavour to give reasonable notice of any such closures.

13. Force Majeure
Cyclopark may close in the case of inclement weather, interruption or failure of electricity, epidemics, restrictions or any acts beyond our control.
